The COVID-19 pandemic, coinciding with the 20th anniversary of the Doha Declaration, has revealed unprecedented and historical challenges in using public health safeguards and flexibilities available under the TRIPS Agreement and national laws.

Several countries and jurisdictions have made efforts to improve their laws. Others discuss reform for future health emergencies. These developments, taking together with the TRIPS waiver deliberation, beg the question of the extent to which international trade rules and the national implementations on intellectual property should be adapted more profoundly and efficiently in light of ensuring access to health technologies.

This joint panel discussion, held with MSF Access Campaign as part of the World Trade Organization (WTO) Public Forum 2021, will critically review and discuss national law responses and experiences addressing intellectual property challenges in a global pandemic and the role of WTO.
